Hi,
On November 2, 2002, I bought a Memorex CDRW that was advertised
by Best Buy as $79.99 which carried a $20 mail in rebate from Memorex
and a $10 rebate from Best Buy. According to the two rebate certificates,
I had to mail the original receipt and UPC bar code to Memorex and a copy
of the receipt and UPC bar code to Best Buy which I did within the time
limit stated on the rebate certificates.
Memorex honored their rebate but on January 14, I received a letter from
Best Buy advising that they would not honor their rebate because I did not
include a "copy of the official receipt". Well the copy of the receipt that
they received was a copy of the cash register receipt that was presented
to me at the time of the sale. It was the same cash register receipt that
Memorex used to determine that I was due a rebate. I can't imagine what
would be more "official" than that. Even worse, this letter which was dated
December 14, but not delivered until January 14, indicated that I only had
two days to get a copy of the "offical" receipt to them - January 16.
Include me in the group of customers that will NEVER shop at Best Buy again.
I have already prepared a suit to be filed in the Maryland District Court
seeking a full refund as a result of Best Buy's breach of contract. My decision
to buy that particular drive was based on their written representation that their
would be $30 of mail in rebates in connection with the purchase. Since
the have failed to fulfil their part of the bargain, they have breached their con-
tract. By the time the case is heard in court, DVD-RW's will have dropped in
price and I will use the money that I get back from Best Buy in court to buy
the DVD-RW instead - from Circuit City.
Curiously, when I checked Best Buy's registered agent for service of process
in Maryland, I found that Best Buy had many certificates of incorporation
in Maryland but most of them had been forfeited. Typically a corporation
forfeits its certificate of incorporation for screwing over the state. I guess
Best Buy doesn't care who it screws.
In any case, I found the correct registered agent for service of process and
the suit will be filed this week - hopefully tomorrow. Discovery motions and
interrogatories will follow as soon as Best Buy's registered agent is served
with process. I'll keep the group informed as to the progress of the lawsuit.
