I purchased a cell phone at Best Buy, Bloomingdale, IL, in June of 2002. By October I had replaced the same model phone twice. Tired of re-entering all of my contacts into the phone book I asked the clerk if I could trade my phone in for a different model. I stated my belief that the model I originally purchased could not be trusted to work as advertised. I paid $20 for my phone originally, on the day I returned my phone was retailing for $60. I asked to take any other phone, just not the one I had already had. There was another phone selling for $40 that day, which I asked to exchange my phone for. I was told that I had to pay $20 if I wanted that phone, the only phone I could have and not pay any additional fee was the identical model. So I said something like this, "so I can walk out of here with the $60 phone for free, but if I want the $40 phone, and be happy, I have to pay $20?" I asked to see the manager, who quickly came to quote me the same policy. I tried to compare my phone to an employ.
